2. Scope & Acceptance

These Terms of Service govern the access, browsing, and purchase of goods (physical merchandise and digital goods) available on www.juliaspiri.com.

By placing an order, creating an account, or browsing this website, you ("Customer" or "User") agree to be bound by these Terms, our Legal Notice, Privacy Policy, and Cookie Policy. If you do not agree with any part of these terms, you must refrain from using this website or placing orders.

3. Products & Services Offered

JULIA SPIRI offers two main types of products:

  1. Physical Goods: Original artworks, hand-sculpted jewelry, physical prints, and craft merchandise.

  2. Digital Goods: Instant downloadable digital files, including grayscale/line-art printable coloring pages, digital art books, and printable assets.

We strive to display the colors, textures, and details of our products as accurately as possible. However, exact display colors depend on your screen settings, and handmade physical items (e.g., polymer clay pieces) may feature slight unique variations.

4. Prices, Taxes, and Payment Terms

  • Pricing: All prices listed on the website are displayed in Euros (€) or your local auto-converted currency and include applicable Value Added Tax (VAT) for European Union residents, unless stated otherwise at checkout.

  • Shipping Fees & Customs: Shipping costs for physical items are calculated and displayed before you finalize your order. For orders shipped outside the European Union, the recipient is responsible for any local import duties, taxes, or customs clearance fees imposed by the destination country.

  • Payment Methods: Payments are processed securely through Shopify Payments, PayPal, Stripe, or other certified payment gateways complying with PCI-DSS standards. Orders will only be dispatched or made available for download upon full verification of payment.

5. Orders & Digital Download Licensing

Physical Orders

Once an order for physical merchandise is placed, you will receive an automated confirmation email with order details and tracking information upon dispatch.

Digital Downloads & Personal Use License

Purchasing a digital file (e.g., printable coloring page or digital art book) grants you a personal, non-exclusive, non-transferable, non-sublicensable license strictly limited to personal, non-commercial use.

  • Permitted Use: You may download and print the file as many times as you like for your own personal coloring or enjoyment.

  • Prohibited Uses: You may NOT share, redistribute, resell, upload to file-sharing websites, alter, vectorization, scan for resale, create derivative products for sale, or use any artwork/digital files in machine learning or AI models. All copyrights remain exclusively with Yuliya Spiridonova.

6. Shipping & Delivery (Physical Goods)

  • Delivery Times: Physical orders are dispatched from Spain within the processing time indicated on each product page. Estimated delivery times depend on the carrier selected (e.g., local postal service, DHL, FedEx, UPS) and the destination country.

  • Delivery Limits: Standard delivery shall not exceed thirty (30) calendar days from the date of order confirmation, unless a longer lead time is explicitly agreed upon for custom/commissioned items.

  • Risk of Loss: Risk of loss or damage to physical goods passes to the consumer upon physical delivery to the recipient or an authorized representative at the designated shipping address.

7. Right of Withdrawal & Returns Policy

A. Physical Goods (14-Day Right of Return)

In accordance with EU Directive 2011/83/EU and the Spanish Consumer Protection Act (LGDCU), European consumers have the right to withdraw from the purchase of physical goods within 14 calendar days from the day the goods are physically delivered, without giving any reason.

  • How to Return: To initiate a return, you must notify us in writing via email at contact@juliaspiri.com prior to the expiration of the 14-day period.

  • Condition: Items must be returned unused, undamaged, in their original condition and packaging.

  • Return Shipping Costs: The customer is responsible for paying direct return shipping costs, unless the item delivered was defective, incorrect, or damaged upon arrival.

  • Refunds: Refunds will be issued via the original payment method within 14 days of receiving the returned item or proof of return shipment.

B. Digital Goods (Exclusion of Withdrawal Right)

Under Article 103(m) of the Spanish Consumer Law (LGDCU) and EU Consumer Law, the right of withdrawal does NOT apply to digital content delivered via instant digital download once performance has begun.

By purchasing a digital download product on www.juliaspiri.com, you explicitly acknowledge and agree that:

  1. Access/download links are provided immediately upon payment confirmation.

  2. You grant express consent to begin performance of the digital contract immediately.

  3. You waive and lose your 14-day right of withdrawal once the download of the digital file has started.

8. Statutory Legal Warranty

For physical goods delivered to EU consumers, we provide the statutory legal warranty of conformity as mandated by applicable European and Spanish consumer protection laws (3 years for physical goods). In case of a defective or non-conforming physical item, you are entitled to have the product repaired, replaced, or refunded free of charge.

9. Intellectual Property & Copyright Notice

All original artwork, illustrations, designs, digital files, images, branding, text, and website structure published on www.juliaspiri.com are the exclusive intellectual property of Yuliya Spiridonova (Julia Spiri) and are protected under Spanish Intellectual Property Law (Real Decreto Legislativo 1/1996), European copyright laws, and international treaties.

10. Online Dispute Resolution (ODR) for EU Consumers

11. Applicable Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Spain.

If you are a consumer residing within the European Union, any legal dispute arising from these Terms or purchases made on this website shall be subject to the non-exclusive jurisdiction of the competent courts of your place of residence/domicile. If you are acting as a business entity or purchasing outside consumer protection laws, disputes shall be submitted to the Courts and Tribunals of Barcelona, Spain.
